Terms and Conditions

Learn Oscar is a service of Learn Oscar UG (haftungsbeschränkt) (afterwards referred to as Learn Oscar) (Lindenstr. 261, 40235 Düsseldorf, Wilhelm Joubert). Learn Oscar provides following services to end customers under the following terms and conditions.
Learn Oscar is an online marketplace ("online marketplace" or "platform") which offers registered members ("members") the opportunity to offer or book services (with learning content) ("lessons"). Third parties offering lessons are referred to as "coaches." Members who have booked lessons are referred to as "students". Lessons may include any services related to leisure and education.
Coaches are solely responsible for their listings, including the content and the lessons itself. Learn Oscar is only the operator of the platform and does not offer lessons or act as service provider of the lessons.
When students book lessons, they enter a contract directly with the coach. Learn Oscar is neither directly nor indirectly involved in the contract. Any claims or disputes resulting from this contract must be settled directly between the student and coach.
To book a lesson on Learn Oscar, you must be at least 18 years or older and able to enter legally binding contracts.

Conditions for Coaches:

In order to offer Lessons on the Learn Oscar platform you have to be a member and create an account first. Coaches can offer several lessons simultaneously.
Coaches are obliged to ensure the correctness of their listings and all content and to keep their listings up to date. Coaches will ensure that their content: images, texts, videos & other materials used, are not violating any third-party rights (e.g. copyrights) or regulations and are liable for any damages that might occur by not complying to this.
Coaches are solely responsible for the execution of lessons and will ensure that lessons comply with any and all laws, regulations and obligations.
Coaches are solely responsible to ensure that they report tax and any other information needed to all relevant authorities.
Coaches will not include any personal contact information such as email addresses or telephone numbers in their listings. Coaches’ contact details will solely be made available to students after students have booked a lesson or lessons with them by Learn Oscar.
Learn Oscar reserves the right to remove listings at any time and without reason or prior notice or, especially or if the impression exists that the listing is not complying with local laws and regulations or if the listing is violating third party rights.
Coaches grant Learn Oscar non-exclusive rights to use, reproduce, edit, distribute, display and exhibit all content (e.g. texts, photos, videos) published on Learn Oscar free of charge as long as the they are members of Learn Oscar and the right to make it publicly available through its own or 3rd party platforms (e.g. social media platforms).

Service fees:

A service-fee (commission) of 15% will be deducted once a month from coaches. The commission fee will be deducted at the beginning of the month for lessons that have been sold via Learn Oscar and have taken place during the previous month. Coaches will not be charged for cancellations (if within the accepted cancellation period of the coaches) or for lessons for which payment were not received (and has been indicated as such by the coaches).

Payment Conditions:

Coaches can decide what payment methods they accept for bookings and need to provide the relevant information for the accepted payment methods during the creation of the lessons. Currently coaches can accept following payment methods: PayPal, Direct Debit (bank transfer) and cash. Coaches must provide the payment details for the selected payment methods during the creation of the lesson. The payment details will be shared with students after they have booked a lesson and can also be retrieved via the booking page by students at a later stage. For PayPal a surcharge of 3% will be added to the total amount for the lesson(s) booked by Students. This 3% surcharge is there to cover the cost for PayPal transactions itself and to protect coaches from costs in case of cancellations by students.
Learn Oscar is not responsible for payment whatsoever and it must be clarified between students and coaches directly.

Cancellation conditions:

In case of cancellation by students, coaches only need to refund the amount paid for the lesson or lessons (excluding all transaction fees).
In case of cancellations by coaches, coaches are obliged to refund students 100% of the amount which students have paid for the lessons itself as well as any transaction fees (such as PayPal fees) that students might have paid.
Learn Oscar is not responsible for refunds whatsoever and refunds must be clarified between students and coaches directly.

Termination of membership:

If a coach decides to terminate his membership, he is still obliged to offer all lessons that he has sold on Learn Oscar.
Coaches are entitled to cancel their membership at any time. In order to cancel their membership, they must write Learn Oscar an email via the address that can be retrieved from the Edit Profile page under Profile.
If a coach terminates his account, all his information will be deleted within 60 days after his last lessons has taken place. In case a coach creates further lessons after the deletion request, his account will be deleted within 60 days after the last of the newly created lessons has taken place.
Certain information such as reviews might not be deleted.

Conditions for students:

The total cost for the booking of single or multiple lessons for a single or multiple students will be displayed prior to finalising the booking on a booking confirmation page. Once the booking has been finalised, a contract has been entered between the student and the coach offering the lesson.
Students’ contact details will solely be made available to coaches after students have booked a lesson or lessons with them by Learn Oscar.

Service fees:

The usage of Learn Oscar is free of charge for students.

Cancellation conditions

In case of cancellations, if accepted by coaches and within the cancellation period accepted by coaches, coaches are obliged to refund students 100% of the amount which they have paid for the lessons itself.
Learn Oscar is not responsible for refunds whatsoever and refunds must be clarified between students and coaches directly.

Termination of membership

If a student decides to terminate his membership, he is still obliged to participate in all booked lessons.
Students are entitled to cancel their membership at any time. In order to cancel their membership, they must write Learn Oscar an email via the address that can be retrieved from the Edit Profile page under Profile.
If a student terminates his account, all his information will be deleted within 60 days after his last lesson that he has booked has taken place. In case a student books further lessons after the deletion request, his account will be deleted within 60 days after the last lesson he has booked, has taken place.
Certain information such as reviews might not be deleted.

Changes to the Terms & Conditions:

Learn Oscar reserves the right to change its Terms & Conditions at any time. If there are any changes, we will contact you one month before the new Terms & Conditions become effective via email to inform you about the changes. If you do not agree with the changes, you can terminate your membership to the end of the deadline as stipulated in the email. If you do not terminate, your membership within the above mentioned period of one month, the new Terms & Conditions will apply.
